OMA initially fired and sued De Groft after the FBI <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/rehs.com\/eng\/2022\/06\/a-bad-week-for-basquiat\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">raided the museum<\/span><\/a><span data-preserver-spaces=\"true\"> during an exhibition featuring twenty-five newly discovered works by Jean-Michel Basquiat. The works <\/span><span data-preserver-spaces=\"true\">were seized<\/span><span data-preserver-spaces=\"true\"> since they are likely all forgeries. Evidence suggests that De Groft probably knew that the Basquiats were fakes and that he had conspired with the paintings\u2019 owners to get a cut of the profits from any future sale in exchange for the authentications. Though he denies it, De Groft has a history of <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/rehs.com\/eng\/2023\/08\/the-orlando-basquiats-former-director-sued\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">making miraculous rediscoveries from which he has tried to profit<\/span><\/a><span data-preserver-spaces=\"true\">. Despite <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/rehs.com\/eng\/2023\/11\/the-orlando-basquiats-former-director-sues\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">filing his countersuit in November 2023<\/span><\/a><span data-preserver-spaces=\"true\">, the museum has finally responded. In a recent court document, the museum states it \u201cdenies it committed any of the unlawful actions alleged in the Amended Counterclaim and denies De Groft is entitled to any of the relief sought\u201d. The parties involved have opted for a jury trial scheduled for October 2025.<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">Lawsuit Brought Against Christie\u2019s Over Cyberattack<\/p>\n<p><\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">On June 5th, two days after OMA responded to De Groft\u2019s counterclaim, <\/span><span data-preserver-spaces=\"true\">Christie\u2019s was hit<\/span><span data-preserver-spaces=\"true\"> with a lawsuit over their handling of the cyberattack that forced them to shut down their website last month. We now know that the hacker group RansomHub <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.theguardian.com\/us-news\/article\/2024\/may\/12\/christies-cyberattack-new-york\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">launched a cyberattack against the auction house on May 9th<\/span><\/a><span data-preserver-spaces=\"true\">, shortly before <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/rehs.com\/eng\/2024\/05\/the-may-marquee-sales-an-overview\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">the May Marquee sales<\/span><\/a><span data-preserver-spaces=\"true\"> in New York. Consequently, the auction house shut down its website for ten days. The auctions continued as planned, with viewers able to watch via live stream on the Christie\u2019s YouTube page instead of through Christie\u2019s Live. RansomHub claimed responsibility for the attack on May 27th, and Christie\u2019s emailed clients on May 30th explaining the situation. In the email, the company reassured clients that the attack had not compromised any financial data. This recent lawsuit alleges that while <\/span><span data-preserver-spaces=\"true\">financial<\/span><span data-preserver-spaces=\"true\"> data was kept<\/span><span data-preserver-spaces=\"true\"> safe, personal information <\/span><span data-preserver-spaces=\"true\">was still breached<\/span><span data-preserver-spaces=\"true\">. It <\/span><span data-preserver-spaces=\"true\">is estimated<\/span><span data-preserver-spaces=\"true\"> that the cyberattack compromised information on nearly 500,000 clients.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The lawsuit claims the cyberattack was made possible because of the \u201cfailure to implement adequate and reasonable cyber-security procedures and protocols necessary to protect consumers\u2019 [personally identifiable information] from a foreseeable and preventable cyberattack\u201d. While the lawsuit is a class action, the only member of the class now identified is Efsthathios Maroulis, a business executive based out of Dallas. The kind of data compromised in the cyber attack, known as personally identifiable information (PII), is a hot commodity on the dark web for identity theft. Maroulis has his own angle on the situation, though. The companies he\u2019s involved with are primarily digital marketing, meaning that, to do his job, his company buys personal data from data brokers to craft targeted marketing for specific demographics. His lawsuit complains that the data of those affected by the cyberattack is now worth less than before, allowing more companies to purchase this data for marketing purposes. He is asking for damages, payment of legal fees, and a court order to force Christie\u2019s to implement the necessary updates to better protect client information. The group\u2019s alleged leader, Gary Lamont, <\/span><span data-preserver-spaces=\"true\">has already<\/span><span data-preserver-spaces=\"true\"> pleaded guilty in December to charges of forgery, making false statements, and defrauding the public. But now, <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.theartnewspaper.com\/2024\/06\/06\/ringleader-norval-morrisseau-forgery-ring-canadian-art-fraud-pleads-guilty\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">another of the ringleaders has done the same<\/span><\/a><span data-preserver-spaces=\"true\">. David Voss is the one who directly oversaw the production of the Morrisseau forgeries and has now pleaded guilty to the charges associated with his illicit activities. Efforts are still underway in identifying the hundreds of forgeries the group produced and sold. The Canadian Conservation Institute, however, has found that the best way to spot a fake is by scanning the work to see if there is a preliminary drawing in pencil beneath the paint. This is one of the best ways to determine that the painting was done by the forgery ring and not Morrisseau himself.<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">Case Dismissed in Van Gogh Restitution<\/p>\n<p><\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">With the Houston Museum of Fine Art <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.theartnewspaper.com\/2024\/06\/06\/ringleader-norval-morrisseau-forgery-ring-canadian-art-fraud-pleads-guilty\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">winning its legal battle to keep a Nazi-looted Bernardo Bellotto painting<\/span><\/a><span data-preserver-spaces=\"true\">, there was another defeat for restitution advocates this week. A federal court has dismissed a lawsuit brought by the descendants of the Mendelssohn-Bartholdy family against the Japanese company Sompo Holdings.\u200b\u200b Due to the pressures of Nazi Aryanization laws, the family, once some of the most prominent bankers in Germany, sold their art collection under duress, <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/rehs.com\/eng\/2022\/12\/give-us-back-our-van-gogh\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">including the Van Gogh painting <\/span><\/a><em><a class=\"editor-rtfLink\" href=\"https:\/\/rehs.com\/eng\/2022\/12\/give-us-back-our-van-gogh\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Vase with Fifteen Sunflowers<\/span><\/a><\/em><span data-preserver-spaces=\"true\">. The family claims that when Sompo Holdings bought <\/span><em><span data-preserver-spaces=\"true\">Sunflowers<\/span><\/em><span data-preserver-spaces=\"true\"> at auction in 1987, the company was fully aware of the painting\u2019s problematic provenance yet went ahead with the purchase anyway. The painting has since <\/span><span data-preserver-spaces=\"true\">been permanently displayed<\/span><span data-preserver-spaces=\"true\"> in Tokyo at Sompo\u2019s museum. Despite this, the courts say that they have no jurisdiction in this matter. The Mendelssohn-Bartholdy family has not indicated if they will continue their legal battles in Japan.<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">UArts Closure Sparks Lawsuit<\/p>\n<p><\/span><\/h2>\n<div id=\"attachment_54210\" style=\"width: 257px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/rehs.com\/eng\/wp-content\/uploads\/2024\/06\/The_University_of_the_Arts_UArts_53590485989.jpg\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" aria-describedby=\"caption-attachment-54210\" class=\"wp-image-54210\" src=\"https:\/\/rehs.com\/eng\/wp-content\/uploads\/2024\/06\/The_University_of_the_Arts_UArts_53590485989-300x169.jpg\" alt=\"The neoclassical fa\u00e7ade of Philadelphia's University of the Arts\" width=\"247\" height=\"139\" srcset=\"https:\/\/rehs.com\/eng\/wp-content\/uploads\/2024\/06\/The_University_of_the_Arts_UArts_53590485989-300x169.jpg 300w, https:\/\/rehs.com\/eng\/wp-content\/uploads\/2024\/06\/The_University_of_the_Arts_UArts_53590485989-448x250.jpg 448w, https:\/\/rehs.com\/eng\/wp-content\/uploads\/2024\/06\/The_University_of_the_Arts_UArts_53590485989.jpg 640w\" sizes=\"(max-width: 247px) 100vw, 247px\" \/><\/a><p id=\"caption-attachment-54210\" class=\"wp-caption-text\">The University of the Arts, Philadelphia (photo courtesy of Ajay Suresh)<\/p><\/div>\n<p><span data-preserver-spaces=\"true\">Finally, the most recent news: Philadelphia\u2019s University of the Arts faces a lawsuit <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/rehs.com\/eng\/2024\/06\/uarts-abruptly-announces-closure\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">following its abrupt closure<\/span><\/a><span data-preserver-spaces=\"true\"> last week. Given the suspicious circumstances under which the school announced its closure, there <\/span><span data-preserver-spaces=\"true\">were bound<\/span><span data-preserver-spaces=\"true\"> to be calls for an investigation. Appropriately, a class action lawsuit was brought against the school by nine employees, including professors and department heads. As I pointed out when I first covered the story, UArts\u2019 choosing not to tell their staff and student body about the school shutting down until the last minute might get them into legal trouble. Specifically, a company with over one hundred employees is legally obligated to give their staff sixty days\u2019 notice in advance of any mass layoffs or closures in accordance with the Worker Adjustment and Retraining Notification Act. The plaintiffs also accuse the school of withholding wages. <\/span><span data-preserver-spaces=\"true\">Eric Lechtzin, an attorney representing the former staff members, described the school\u2019s decisions as \u201cincomprehensible\u201d<\/span><span data-preserver-spaces=\"true\">, <\/span><span data-preserver-spaces=\"true\">and that the situation \u201creflects a complete failure of leadership\u201d.<\/span><span data-preserver-spaces=\"true\">\u00a0 On June 7, Pennsylvania Attorney General Michelle Henry announced her office would investigate the events surrounding UArts\u2019s closure. Both the Philadelphia City Council and state lawmakers are organizing hearings, initiating investigations <\/span><span data-preserver-spaces=\"true\">of their own<\/span><span data-preserver-spaces=\"true\"> through committees.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>These past few days, the art world has been abuzz with lawsuits, with those involved ranging from museums, auction houses, art schools, and proper criminals.
